Agreement to Terms

By accessing or using CreatorToolkit ("the Service") at https://www.apicreatorstools.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Description of Service

CreatorToolkit is a curated directory of AI tools designed for content creators. The Service allows users to:

  • Browse and search for AI tools across various categories
  • Submit tools for free listing consideration
  • Purchase premium listings for featured placement
  • Subscribe to our newsletter for updates about new tools

User Accounts and Registration

Most features of the Service are available without registration. Administrative access is restricted and requires authentication. You are responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account.

Tool Submissions

Free Listings

You may submit tools for free listing consideration. All submissions are subject to review and approval by CreatorToolkit. We reserve the right to:

  • Accept or reject any submission at our sole discretion
  • Edit or modify submission content for clarity, accuracy, or compliance
  • Remove listings at any time without prior notice
  • Require additional information or verification before approval

Premium Listings

Premium listings are paid subscriptions that provide:

  • Featured placement with distinctive styling (gold/amber gradient design)
  • Priority positioning in category listings and search results
  • Guaranteed approval (subject to content guidelines)

Pricing: Premium listings are billed at $49 USD per month as a recurring subscription.

Submission Guidelines

All tool submissions (free and premium) must:

  • Be legitimate AI tools or software products designed for content creators
  • Include accurate and truthful information
  • Not contain malware, phishing content, or malicious software
  • Not violate intellectual property rights of others
  • Not promote illegal activities, hate speech, or adult content
  • Include a functional website URL

We reserve the right to remove any listing that violates these guidelines, even after initial approval.

Payment Terms

Payment Processing

All payments for premium listings are processed securely through Stripe, a third-party payment processor. By purchasing a premium listing, you agree to Stripe's Terms of Service.

Subscription Billing

  • Premium listings are sold as monthly recurring subscriptions billed automatically each month
  • Your subscription will renew automatically unless cancelled before the renewal date
  • Payment is charged immediately upon purchase and on each monthly renewal date
  • All fees are in USD and are non-refundable except as required by law

Cancellation and Refunds

  • You may cancel your premium subscription at any time through your Stripe customer portal or by contacting us
  • Cancellation takes effect at the end of the current billing period; you will not be charged for subsequent periods
  • No refunds are provided for partial months or unused portions of your subscription, except as required by law
  • Upon cancellation, your listing will revert to standard (non-premium) status or be removed based on your preference

Price Changes

We reserve the right to modify our pricing at any time. Price changes will not affect existing subscriptions until renewal, and you will be notified at least 30 days in advance of any price changes.

Intellectual Property Rights

Your Content

You retain ownership of all content you submit to CreatorToolkit, including tool descriptions, images, and logos. By submitting content, you grant CreatorToolkit a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the Service and in promotional materials.

Our Content

The Service, including its design, layout, graphics, and original content (excluding user submissions), is owned by CreatorToolkit and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Submit false, misleading, or fraudulent information
  • Transmit malware, viruses, or harmful code
  • Engage in scraping, data mining, or automated data collection without permission
  • Attempt to gain unauthorized access to any part of the Service
  • Harass, abuse, or harm other users
  • Spam or send unsolicited communications
  • Circumvent or manipulate our ranking or search algorithms

Third-Party Links and Services

The Service contains links to third-party websites and tools. We are not responsible for the content, privacy practices, or terms of service of these third-party sites. We do not endorse or guarantee any third-party tools listed in our directory. Use of third-party services is at your own risk.

Disclaimers and Limitation of Liability

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • The information provided on the Service is accurate, complete, or current
  • Any tools listed will meet your requirements or expectations
  • Any defects or errors will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATORTOOLKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless CreatorToolkit and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you submit to the Service

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Modifications to Service and Terms

We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice. We may also revise these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date.

Your continued use of the Service after any changes indicates your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Informal Resolution

If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and CreatorToolkit individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CreatorToolkit regarding the Service and supersede all prior agreements and understandings.
